Motorsport Tickets Terms & Conditions of Sale

Seat locations are allocated by the Supplier. The ticket holder has a right only to a seat of a value corresponding to that stated on the ticket and the Supplier or Motorsport Tickets reserves the right to provide alternative seats to those specified on the ticket.
Viewing area facilities including grandstand covers and large-screen televisions do not constitute part of the ticket value and they can be withdrawn or amended without notice.
Tickets are sold subject to the terms and conditions of the Supplier, and the additional terms and conditions of Motorsport Tickets. Please contact us if you require a copy of Supplier conditions for your event.
In exceptional circumstances, the Supplier may reserve the right to make minor alterations to the advertised arrangements.
The Supplier reserves the right to refuse you admission if, in its reasonable opinion, your admission to the organisation might be a risk to (a) the safety of the audience and/or yourself; and/or (b) affect the enjoyment of members of the audience; and/or (c) affect the running of the event, performance or task, for example, if you act aggressively and/or appear to be under the influence of drink and/or drugs. Should this occur you will not be entitled to a refund.
It is your responsibility to check whether an event, performance or time has been cancelled or rescheduled. Motorsport Tickets will use its reasonable efforts to contact you in the event of cancellation once we have received the relevant authorisation from the Supplier.
Events may be cancelled or postponed by the Supplier for a variety of reasons. In this event, Motorsport Tickets will not be held responsible for any such cancellations or postponements.
You may be entitled to a refund if the event is cancelled, rescheduled or if there is a material change to the subject matter of the ticket contract that is what you have contracted to see. Please contact us via help@Motorsporttickets.com for information on receiving a refund from the Supplier. Please note we may require you return to us your ticket un-defaced in its original state for you to receive a refund, and failure to do so may forfeit your entitlement to a refund of any description.
The amount of any refund provided is dependent on the circumstances and the decision of the Supplier. Refunds will not include service and delivery fees and may not include Motorsport Tickets's ticket margin/commission. Any fee for Booking Protection cover is non-refundable.
In the event of breach of the contract by the Supplier, the Supplier shall not be liable for any loss, damage, cost or expense arising out of the breach which was not reasonably foreseeable by the Supplier at the date of the contract for the sale of tickets, except in respect of death or personal injury resulting from any act or omission on the part of the Supplier.
Ticket holders consent to filming and sound recording as members of the audience.
The ticket holder must comply with all relevant statutes, organisation regulations and safety announcements whilst attending the event.
Motorsport events can be dangerous. Motorsport Tickets cannot accept responsibility for any injury, loss, or cost as a result of attending the event. You attend at your own risk and any disputes must be taken up directly with the event organiser.
Where an age restriction applies for an event this will be indicated during the ticket booking process and confirmed on your booking confirmation. Please ensure that you carry proof of age, if appropriate, as Motorsport Tickets can in no way be held liable for failure to comply with age restrictions imposed by the supplier and any subsequent action taken against such failure.
As a ticketing agent we do not control the running of the event. Any complaint about the event itself is the responsibility of the Supplier and not Motorsport Tickets.

PRICING AND PAYMENT

If an honest error has been made with displayed prices on the Motorsport Tickets website, we reserve the right to ask you for the difference in payment before confirming an order, releasing tickets, or reserve the right to cancel the order.
The price printed on your ticket or other documentation may not always match the price you have paid on your booking. We source tickets and services from a number of suppliers at different prices and we may add a margin to these prices. Further to this, the face value does not always reflect any service charges paid by Motorsport Tickets to the Supplier.
All prices are inclusive of any applicable VAT.
Payment must be made in either Australian Dollars (AUD), Canadian Dollars (CAD), Euro (EUR), Great British Pounds (GBP), or United States Dollars (USD). The payment amount and currency are clearly stated on the checkout and booking pages and cannot be disputed after your booking is completed.
Failure to supply the correct credit or debit card billing address information and/or cardholder details may result in delays to the issue of your tickets and may make the total booking cost subject to increase. We also reserve the right to cancel tickets after issue if payment is declined or incorrect cardholder details and billing information have been supplied. Further, in an effort to minimise the effects of credit card fraud, we reserve the right to carry out random checks, including checks of the electoral roll, and may request you to either email, or post to us proof of your address, identification, a copy of the credit card and recent statement before issuing any order.
Bookings must be paid for in full within the period of payment agreed on the invoice or email. Motorsport Tickets has the right to resell tickets and cancel invoices if payment is not made according to the conditions. Any deposit paid may be forfeited if you do not comply with the payment terms.
If prices change on a booking before it is confirmed, Motorsport Tickets reserve the right to request the additional cost or refund you in full.
If for any reason a refund is due, it will be refunded in the booking currency and, where possible, to the original payment account.

BOOKING

A successful payment to Motorsport Tickets does not guarantee your booking will be secured. Only when your payment is fully cleared will we attempt to confirm your booking. Any material from Motorsport Tickets that implies payment clearance will lead to a confirmed booking is done for the purposes of explanation and because this is the normal process.
If we are unable to fulfil your booking request, we will contact you to advise you of the situation. At this point we will give you the option of amending your booking or obtaining a full refund if applicable.
Bookings generally cannot be cancelled once paid as this is the policy of Suppliers. If you have taken out Booking Protection please click here for information on making a claim. If you are not covered or are unable to make a claim, at the discretion of Motorsport Tickets if we are able to re-allocate your booking to a separate customer, then a partial refund may be offered. Please contact us for any cancellation requests.
It is your responsibility to monitor the status of your order. Failure to receive correspondence from Motorsport Tickets after an order has been placed does not guarantee a void order and so you must clarify any order queries with Motorsport Tickets.

Motorsport Tickets Terms & Conditions

BY PURCHASING A TICKET, THE TICKET HOLDER (YOU) AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF SALE SPECIFIED HEREIN AND ANY OTHER PROVISION AS MAY BE SPECIFIED FROM TIME TO TIME BY US, THE EVENT ORGANISER OR THE OWNER OF THE TICKETING PLATFORM (EVENTCUBE).

EVENT TICKETS ARE NON-TRANSFERABLE AND NON-REFUNDABLE EXCEPT IN THE INSTANCE OF EVENT CANCELLATION. IF AN EVENT IS CANCELLED, YOU WILL BE ENTITLED TO A REFUND OF THE TICKET PRICE LESS THE BOOKING FEES AND ANY OTHER CHARGES WHICH WE CANNOT RECOVER.

We sell paper or e-tickets (Tickets) for events advertised on websites owned and operated by us from time to time (Events) using Eventcube's 'Ticket Mechanic'. Eventcube is a trading name of Eventcube Solutions Ltd, a company incorporated in England under company number 08939283.

The party who organises and provides the Event is the Event Organiser

1. YOUR RELATIONSHIP WITH THE EVENT ORGANISER (Motorsport Tickets)

The Ticket is issued subject to the Event Organiser's terms and conditions found on its website, at the box office, or in the Terms & Conditions of entry to any on-line Event (Event Organiser T&Cs)
If you breach any of the Event Organiser T&Cs or behave in an unacceptable manner (see Section 4 below), the Event Organiser is entitled to refuse you entry to the Event.
The Event Organiser may alter or vary the Event due to circumstances beyond its reasonable control without being obliged to refund monies or exchange Tickets.

2. YOUR RELATIONSHIP WITH EVENTCUBE

EVENTCUBE WILL NOT BE RESPONSIBLE FOR ANY REFUNDS TO TICKET HOLDERS
Your use of the Eventcube website to purchase Tickets, and the transmission of your personal data to Eventcube to enable the purchase of Tickets is subject to the terms of Eventcube's privacy policy: https://www.eventcube.io/legal/privacy-policy
You acknowledge that Eventcube may store and transmit your personal data in accordance with its Privacy Policy.

3. YOUR TICKETS

Once your Tickets are issued (in paper or electronic form), it is your responsibility to keep them safe. We will not be responsible for Tickets which have been lost, stolen or destroyed.
E-Tickets do not incur any additional charges than our processing fees, Physical Paper tickets will incur an extra printing and postage cost.
The general limit for ticket purchases for an individual ticket release for an Event is 6, and this may be lowered in certain circumstances. This policy is in effect to discourage unfair ticket buying practices.
Tickets may be restricted to a maximum number per person, per credit card and, for some events, a restriction may apply per household. We reserve the right to cancel Tickets purchased in excess of this number without prior notice.
Multiple tickets orders cannot be split. The primary Ticket holder must be present to enter the Event with E-tickets.
If you are splitting barcoded E-Tickets you may print out each barcode separately and provide the other parties with relevant identification details, however entry will be entirely at the discretion of the Event Organiser.
We try and ensure that all prices on our website are accurate, however errors may occur. If we discover an error in the price of Tickets you have ordered, we will inform you as soon as possible and give you the option of reconfirming your Ticket purchase at the correct price (and credit or debit your account as applicable) or cancelling your Ticket purchase. If we are unable to contact you, you we may treat the Ticket purchase as cancelled.
It is your responsibility to ensure that your Ticket purchase contains the correct information. We are not responsible for correcting information which you have provided, however we will use all reasonable efforts to remedy errors where possible.
UNLAWFUL RESALE OF TICKETS IS STRICTLY PROHIBITED. IF WE REASONABLY SUSPECT THAT TICKETS HAVE BEEN PURCHASED FOR UNLAWFUL RESALE, WE MAY CANCEL THE RELEVANT TICKETS WITHOUT ANY RIGHT TO COMPENSATION OR REFUND.

4. ADMISSION TO THE EVENT

The Event Organiser reserves the right to refuse admission, and to request any Ticket Owner to leave the venue (including an on-line venue) at any time for reasons of public safety. This includes, but is not limited to: (i) crowd surfing and moshing; (ii) aggressive behaviour; (iii) acting under the influence of alcohol or drugs; (iv) carrying an offensive weapon; (v) failure to comply with any measures put in place to combat the spread of Covid-19, and/or (vi) any unacceptable behaviour likely to cause damage, nuisance or injury, or for any breach of the Event Partners´ terms and conditions. You will not be entitled to a refund.
A Ticket Owner may be asked to leave an on-line event for failing to observe the acceptable use policy for the relevant Event.
The Event Organiser reserves the right to refuse re-admission to any person not in possession of a Ticket or the retained portion of the Ticket.
Latecomers may be admitted at a suitable point in the performance at the discretion of the Event Organiser.
You acknowledge that there may be security checks at any venue.

5. EVENT CANCELLATION

If an Event is cancelled or rescheduled, we will use reasonable endeavours to notify YOU of the cancellation once we have received the relevant authorisation from the Event Organiser, however we do not guarantee that ticket holders will be informed of such cancellation before the date of the Event.
Unless indicated otherwise in relation to a particular Event, if an Event is cancelled, you will be offered seats at the rescheduled Event/s (subject to availability) up to the face value of the Tickets or, if you are unable to attend the rescheduled Event or the Event is not rescheduled, a refund of the ticket price.
Refunds for Tickets purchased prior to the date of the original Event will be given up to their face value. If an Event takes place over several days and only one day is cancelled, you will be entitled to a pro-rata refund.
IF THE EVENT IS RESCHEDULED, THE EVENT ORGANISER MAY SET REFUND LIMITATIONS.

6. PHOTOGRAPHY & VIDEO RECORDING

You must not take any unauthorised audio, video, photographic or digital recording apparatus of any kind into any of the performance areas, nor make any audio, video or photographic recordings of any kind. The Event Organiser reserves the right to confiscate any unauthorised audio, video and photographic recordings.
You consent to filming and sound recording as members of the audience (at a venue or on-line).

7. LIABILITY

Personal arrangements including travel, accommodation or hospitality relating to an Event which have been arranged by you are at your own risk. Unless otherwise stated in this clause, our and the Event Organiser's liability to you in connection with the Event (including, but not limited to, in the event of cancellation, rescheduling or material change to the programme of the Event) shall be limited to the Ticket price paid by you.
Subject to Section 7.3, neither we, Eventcube or the Event Organiser (Event Partners) will be responsible for any loss, injury or damage to any person (including you) nor property howsoever caused.
Nothing in these Terms and Conditions seeks to exclude or limit our or the Event Partners' liability for death or personal injury caused by our or the event partner(s)' (as relevant) negligence, fraud or other type of liability which cannot by law be excluded or limited.

8. FORCE MAJEURE

Force Majeure Event means any circumstance not within a party's reasonable control including, without limitation:
1. acts of God, flood, drought, earthquake or other natural disaster;
2. epidemic or pandemic;
3. terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relation;
4. nuclear, chemical or biological contamination or sonic boom;
5. any law or any action taken by a government or public authority, including without limitation imposing an export or import restriction, quota or prohibition, or failing to grant a necessary licence or consent;
6. collapse of buildings, fire, explosion or accident; and
7. interruption or failure of utility service.
If the Store Owner is prevented, hindered or delayed in or from performing any of its obligations under this agreement by a Force Majeure Event, it shall not be in breach of this agreement or otherwise liable for any such failure or delay in the performance of such obligations. The time for performance of such obligations shall be extended accordingly.

9. DATA PROTECTION

If you book Tickets with us, we will hold your name, address and other personal data in our database, subject at all times to our Privacy Policy. If you wish to make any requests regarding your personal data, please email support.

10. GENERAL

The Event Partners and their affiliates, successors, or assigns may enforce these terms in accordance with the provisions of the Contracts (Rights of Third Parties) Act 1999 (the Act).
Except as provided above, these Terms and Conditions do not create any right enforceable by any person who is not a party to it under the Act, but does not affect any right or remedy that a third party has which exists or is available apart from that Act.
These Terms and Conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the law of England and Wales. Each party irrevocably agrees that the courts of England shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.
